He has now been on death row at Bentong prison since 2011. Since 2014, his judicial appeals have failed and his petition for a pardon has been pending.

Like all others on death row, he is not at imminent risk of execution since the government has established a nation-wide moratorium on executions in July 2018 – but he remains in limbo.

Hoo Yew Wah’s case illustrates the many violations of international human rights law and standards associated with the use of the death penalty in Malaysia, as documented in this report. These include lack of adequate and timely legal assistance, concerns of torture and other ill-treatment during police interrogation, the reliance on statements or information obtained without a lawyer present, the presumption of guilt in cases of drug trafficking, secretive pardon processes and the extensive use of this punishment for offences that do not meet the threshold of the “most serious crimes” or intentional killing to which the death penalty must be restricted under international law.

Please write immediately in Chinese, English, Malay or your own language urging Sultan Ibrahim Ibni Almarhum Sultan Iskandar, Sultan of Johor State, to grant clemency to Hoo Yew Wah.

Hoo Yew Wah has been on death row at Bentong prison in Malaysia since 2011. In March 2005, at the age of 20, he was found in possession of 188.35 grams of methamphetamine, automatically presumed to be trafficking drugs and later convicted of trafficking under section 39(b) of the Dangerous Drugs Act, 1952.

He was sentenced to the mandatory death penalty on 12 May 2011 and his appeals were later rejected.

His April 2014 petition for a pardon to the Sultan of Johor State, where the offence took place, remains pending.

He turned 33 years old in 2018 and said he repented of his offence.

Please support the request for commutation of the death sentence imposed on Hoo Yew Wah.

Hoo Yew Wah was convicted of drug trafficking after he was found in possession of methamphetamine. He was presumed to be trafficking and was sentenced to the mandatory death penalty in 2011. He was just 20 years old at the time of his arrest; he is now 36 and repented for his offence.

The mandatory death penalty, the imposition of the death penalty for drug-related offences, and the use of ill-treatment and coercion, are all violations of international law.

I am now supporting Hoo Yew Wah’s plea to be given a second chance. Please intervene with the Pardon Board of Johor state and support his pardon application, as well as the commutation of all death sentences in the country.
