We, the undersigned, urge the Malaysian authorities to take immediate, transparent and meaningful action to ensure justice for Teoh Beng Hock.
Over this 11-year span, despite multiple efforts by civil society and Teoh Beng Hock’s family to call for the proper investigation of the case and a court finding of criminal wrongdoing, no one was held accountable, and the MACC officers implicated were never charged. More than a decade later, justice remains elusive for Teoh Beng Hock and his family.
We call on the Malaysian government to:
- Seek the truth: Reopen an independent, transparent, and impartial investigation into Teoh Beng Hock’s death
- Uphold justice: Hold accountable all those responsible for any wrongdoing or misconduct in relation to Teoh Beng Hock’s death, through legal, fair and transparent processes, in accordance with the Court of Appeal verdict.
- Reform institutions: Implement systemic reforms to prevent future deaths in custody, including the establishment of robust and independent oversight mechanisms for all interrogation and custodial procedures carried out by the MACC and other enforcement agencies.
- Amend Section 30 of the MACC Act 2009, which currently permits individuals to be subjected to indefinite, day-to-day questioning without adequate safeguards. The lack of clear time limits and rest provisions under Section 30(3)(a) creates conditions that may amount to psychological coercion or ill-treatment. This provision must be revised to include statutory limits on interrogation durations, mandatory rest periods, access to legal counsel, and independent monitoring.
- Ratify the UN Convention Against Torture (UNCAT) and bring domestic legislation into full alignment with international human rights standards to prevent torture and other ill-treatment and ensure accountability within all enforcement institutions.
Malaysia must demonstrate that no individual is above the law and that the right to life, dignity, and justice is upheld for all. The Malaysian government must not allow custodial deaths to be left unresolved or for families to be denied the truth.
Justice delayed is justice denied. We stand in solidarity with Teoh Beng Hock’s family and all victims of custodial abuse.
